The State Data on Nights Here Is Unusually Stark
California's Office of Traffic Safety ranks every city against others of similar size. Among cities in West Hollywood's population group, it ranked worst in the entire state for crashes between nine at night and three in the morning in 2022, and worst again in 2023.
In 2023 it also ranked worst in California in its group for crashes involving drinking drivers aged twenty one to thirty four, and second worst for pedestrians. Those are the hours and the population that rideshare exists to serve.
There is an honest counterpoint in the same data worth stating. The city sits mid-table for drink driving arrests, around fifty eighth of ninety three. So the problem is not obviously enforcement volume. It is the density of a very small city on a night when a great many people who are not driving themselves are moving through four or five intersections that carry most of its serious crashes.
Two Things That Decide the Claim
The first is what the app was doing at the moment of impact, because that determines which layer of coverage applies and the differences between them are large.
The second is which city you were in. West Hollywood is not Los Angeles, and that changes the police force, the claims process and the courthouse.
What the App Was Doing

No company coverage at all. The statute does not reach a driver who is not logged on, so the claim runs against their ordinary personal policy.
Logged On, Waiting
Fifty thousand per person of primary cover, and then a separate excess layer of at least two hundred thousand on top. The real floor is two hundred and fifty thousand. Material quoting the first figure alone understates what is available by two hundred thousand dollars.
Ride Accepted Through Drop Off
One million dollars of primary liability cover. That attaches when the driver accepts the ride, not when the passenger gets in, so it reaches a pedestrian or another driver struck while the car is still on its way to collect someone.
The Change Almost No Page Has Caught Up With
Until the end of 2025, a rideshare company had to carry one million dollars of uninsured and underinsured motorist cover for a passenger in the vehicle. From 1 January 2026 that is sixty thousand dollars per person and three hundred thousand per incident.
A reduction of more than ninety percent, and it matters here more than in most places. A city with California's worst nighttime crash record in its size class is a city where the other driver is disproportionately likely to be uninsured or barely insured. That sixty thousand is now often the ceiling on the company's side, which makes your own uninsured motorist cover far more important than it was last year.
Note also that the uninsured layer only attaches once the passenger is physically in the car. A rideshare driver struck by an uninsured motorist while driving to a pickup has none of it.
One provision runs the other way and is worth knowing. The statute says expressly that it does not limit a company's liability in an action for damages above the required cover. The limits are a floor on what must be carried, not a cap on what can be recovered.
This Is a Separate City, and It Changes Four Things
West Hollywood incorporated in 1984 and sits between Beverly Hills and Los Angeles. It reads as part of Los Angeles and is not, and every one of the following is different as a result.
Who You Report To
The city has no police department of its own. It contracts with the Los Angeles County Sheriff, and the West Hollywood Sheriff's Station is at 780 North San Vicente Boulevard.
That matters directly for a hit and run. California requires such an accident to be reported within twenty four hours to the police of the city where it happened, as a condition of claiming on your own uninsured motorist cover. Here that is the Sheriff's station above. Report a West Hollywood crash to LAPD and you may have reported to the wrong agency.
Who You Claim Against
If a road condition or a city vehicle contributed, the claim is against West Hollywood, filed with its City Clerk at 8300 Santa Monica Boulevard. The city's own form states that claims for injury must be filed no later than six months after the occurrence, and there is no filing fee. It also accepts claims through an online portal.
There is a split worth knowing. Because Sheriff's deputies are county employees rather than city ones, a claim arising from deputy conduct goes to Los Angeles County instead, at 500 West Temple Street. Same six month clock, different counter.
Who Owns the Road
Santa Monica Boulevard through West Hollywood is not a state highway. It was relinquished to the city, and the statute defining the state route picks it up again only where the boulevard crosses out of West Hollywood at La Brea Avenue.
So Caltrans is not the defendant for a defect on it here. The city is, with the six month deadline that follows. Three blocks east on the same boulevard the answer is different.
Where the Case Is Heard
A West Hollywood case goes west, to the Santa Monica or Beverly Hills courthouse, rather than downtown.
Where the Crashes Actually Happen
The city published its own road safety analysis covering 2017 to 2021 and it names its worst corridors. Santa Monica Boulevard carried 818 crashes and 31 that killed or severely injured someone. Sunset Boulevard carried 650 and 18.
Two patterns in that data shape rideshare cases here. Ninety one percent of all crashes happened at intersections, which is where pickups and drop offs cluster. And while pedestrians were involved in only seven percent of crashes overall, they were involved in forty percent of the ones that killed or seriously hurt someone.
A passenger stepping out on the traffic side of a stopped car, at an intersection, at night, is not an unusual event here. It is close to the city's defining injury pattern, and it is often nobody's fault in the way people expect.
Deadlines
Two years from the crash for the injury claim.
Six months to present a written claim if the city, the county or another public entity is involved.
And a separate rule that catches people: for an uninsured motorist claim, within two years you must have sued the uninsured driver, agreed the amount due, or formally started arbitration by certified mail. Reporting and negotiating does not satisfy it.
